1. Introduction and Acceptance of Terms
1.1 These Terms and Conditions (“Terms”) govern your access to and use of the website https://fashioncrew.co.za/(“Website”), including the purchase of clothing and related products (“Goods”).
1.2 By accessing, browsing or purchasing from the Website you agree to be bound by these Terms. If you do not agree, you must not use the Website or place any orders.
1.3 We may update these Terms from time to time. The updated version will be posted on the Website and the “Last updated” date will change. Your continued use after changes constitutes acceptance of the revised Terms.

3. Products and Orders
3.1 All Goods displayed are subject to availability. We reserve the right to discontinue any product or limit quantities without notice.
3.2 Product images and descriptions are for illustrative purposes. Colours may vary slightly due to screen settings and fabric dye lots. Minor variations do not constitute defective Goods.
3.3 Placing an order constitutes an offer to purchase. We may accept or reject any order (in whole or in part) at our discretion, including due to pricing errors, stock unavailability, or suspected fraudulent activity.
3.4 A contract is formed only when we send you an order confirmation email.
4. Pricing and Payment
4.1 All prices are quoted in South African Rand (ZAR) and include VAT where applicable, but exclude delivery fees unless stated otherwise.
4.2 We may correct obvious pricing errors even after you have placed an order.
4.3 Payment is processed via [Addpay, EFT]. Full payment is required before dispatch.
4.4 Ownership of Goods remains with us until full payment is received.
5. Delivery
5.1 We aim to dispatch orders within [2–5 business days] of payment (excluding weekends and public holidays).
5.2 Delivery times are estimates only. We are not liable for delays caused by couriers, force majeure, or incorrect delivery details provided by you.
5.3 Risk of loss or damage passes to you upon delivery to the address provided (or collection if chosen).
5.4 Additional charges may apply for rural / outlying areas or re-delivery attempts.
6. Returns, Refunds and Exchanges (Consumer Protection Act)
6.1 You have no automatic right to return or exchange Goods simply because you changed your mind (unless bought as a result of direct marketing in which case a 5-business-day cooling-off right may apply under section 16 CPA / section 44 ECTA).
6.2 You may return Goods within 14 days of delivery if they are:
• defective,
• not as described,
• materially different from the sample / description.
6.3 Goods must be:
• unused,
• in original condition with all tags attached,
• returned with original packaging.
6.4 Return shipping costs are your responsibility unless the return is due to our error (wrong item / defective product), in which case we will cover reasonable return courier costs.
6.5 Refunds (where approved) will be processed to the original payment method within 10 business days of receiving and inspecting the returned Goods.
6.6 No refunds on sale / clearance items unless defective.
7. Intellectual Property
7.1 All content on the Website (logos, designs, photographs, text, graphics) is owned by us or our licensors and protected by copyright and trade mark law.
7.2 You may not reproduce, distribute or create derivative works without our written permission.
8. Limitation of Liability
8.1 To the fullest extent permitted by law, we are not liable for any indirect, consequential, special or punitive damages arising from your use of the Website or purchase of Goods.
8.2 Our total liability shall not exceed the amount you paid for the Goods in question.
8.3 Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, or fraud.
9. Privacy and Personal Information (POPIA)
9.1 We collect and process your personal information (name, email, delivery address, phone, payment details) in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).
9.2 We use your information to process orders, deliver Goods, send transactional emails, and (if you consented) marketing communications.
9.3 You have the right to access, correct, or request deletion of your personal information (subject to legal retention obligations).
9.4 We will not share your personal information with third parties except service providers (e.g. couriers, payment gateways) who are bound by similar confidentiality and security obligations.
10. Governing Law and Jurisdiction
10.1 These Terms are governed by the laws of the Republic of South Africa.
10.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Cape Town (Western Cape Division), South Africa.
11. General
11.1 If any provision is held invalid, the remainder shall remain in force.
11.2 No waiver of any breach shall constitute a waiver of any subsequent breach.
11.3 These Terms constitute the entire agreement between you and us regarding your use of the Website and purchase of Goods.
By placing an order or continuing to use Online Shop, you confirm that you have read, understood and agree to these Terms and Conditions.
Our refund and returns policy lasts 14 days. If 14 days have passed since your purchase, we can’t offer you a full refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. If you purchased the goods yourself and meet all the refund requirements, you will receive a full refund, minus delivery charges (if applicable). If you received the goods as a gift, or if you do not have the invoice, we may use our discretion to allow you to exchange the goods for goods of the same value at the same brand store (you will not receive the balance if you exchange the goods for other goods of a lower value), or for a gift card at current price, minus any current promotional discount. To complete your return, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer. There are certain situations where only partial refunds are granted: Excluded Products: For hygiene reasons we cannot accept returns of underwear, lingerie, swimwear, socks, hosiery, bodysuits, earrings, toiletries, cosmetics, perishable food, earrings or any other jewellery used for piercings. You will not be entitled to a refund or exchange of gift cards, personalised, resized, engraved, repaired or updated goods or special order goods. Any item not in its original condition, is damaged or missing parts for reasons not due to our error. Any item that is returned more than 14 days after delivery Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days. Late or missing refunds If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at sales@fashioncrew.co.za . Sale items Only regular priced items may be refunded. Sale items cannot be refunded. Exchanges We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at {sales@fashioncrew.co.za} and send your item to: {physical address}. Gifts If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you. If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return. Shipping returns To return your product, you should mail your product to: {physical address}. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you may vary.
